Trashcan & Recyclables By-Laws Amendment
As of 1 November 1999
The
residents of Burke Overlook have raised concerns about the condition
trash is left at the curb awaiting pickup. According to these concerns,
trash that is placed at the curb in trash bags, store bags, and
other non-trash containers is being invaded by animals and the
weather. This invasion is causing trash to be scattered through
the neighborhood. This does not only cause inconvenience to those
residents who are particularly concerned about the appearance of
our community it is also a major healthy and safety concern. Residents
have communicated at annual meetings and through direct contact
with board members a desire to make trashcans mandatory for all
Burke Overlook residents. The desire for a Trashcan Amendment was
discussed and voted on by a quorum of homeowners at the Burke Overlook
Homeowners annual meeting on March 1st, 1999. Homeowners voted
unanimously to amend the Burke Overlook Homeowners Association
Bylaws to incorporate a requirement for all residents to obtain
and utilize trashcans. The following is the Trashcan & Recyclables
By-Laws Amendment:Trashcan & Recyclables
By-Laws AmendmentPurposeIt
is the intent of this amendment to establish a policy in order
to maintain a healthy, safe, and attractive neighborhood.For the
purpose of Trash Removal, residents are required to:
- Obtain
a plastic or metal trash can with a lid
- Place
all food items and other organic material inside trashcans. No
exceptions
- Place
trashcan at curb for pickup no earlier than 5:00 p.m. on the
night before trash is scheduled to be picked up. (i.e. If trash
is picked up on Tuesday, trashcans are not permitted to be placed
out any earlier than Monday at 5:00 p.m.)
- Remove
trashcan from curbside no later than 11:00 p.m. of the scheduled
day of pickup
- Place
trashcans so they do not obstruct access to mailbox
- Secure
packing material that is being placed out for trash removal (i.e.
all packing material must be secured in order to prevent debris
from being scattered through the neighborhood by wind or other
weather elements. Please tape up boxes with packing and loose
material)
- Secure
oversize non organic trash items (items that do not fit in trashcans)
so they are not scattered throughout the neighborhood by wind
or other weather elements
- Identify
all trashcans by placing residents' house number on the trashcan
For
the purpose of Recyclable Removal, residents are required to:
- Place
recycle bins at curb for pickup no earlier than 5:00 p.m. on
the night before recyclables are scheduled to be picked up. (i.e.
If recyclables are picked up on Thursday, recycle bins are not
permitted to be placed out any earlier than Wednesday at 5:00
p.m.)
- Remove
recycle bins from curbside no later than 11:00 p.m. of the scheduled
day of pickup
- Place
recycle bins so they do not obstruct access to mailbox
- Identify
all recycle bins by placing residents' house number on the bin
FinesPenalty
for noncompliance with the Trashcan & Recyclables Amendment consists
of fines levied by board members, officers of the association, and
committee members appointed by the board. The Amendment is being implemented
to maintain a healthy, safe, and attractive community. The fines are:
- First
offense: Letter from the board
- Second
offense: $10
- Third
offense: $15
- Fourth
offense and beyond: $15
Fines
are payable within 30 days of the offense. Failure to pay fines are
subject to Article V, Sect.8 of the Declaration of Covenants as amended
which imposes a late fee of $10.00 plus an interest charge of 12% per
annum from the due date. All fines are to be sent to the following
